Plain English: Welcome to the beta. The Service is still being built. Things may move, change, or break. Your feedback is gold; if you give it, we get to use it.
1. Scope
This Beta Tester Agreement applies to users who opt into the Market Sniper public beta during the beta window (2026-05-10 through 2026-06-15). It is in addition to (not in lieu of) the Terms of Service, Privacy Policy, Risk Disclosure, Subscription Terms, and other applicable policies. Where this Agreement conflicts with one of those documents on a beta-specific question, this Agreement controls only as to that beta-specific question.
After the beta window closes, this Agreement is superseded by the standard Terms of Service for all users (including former beta participants); standard Terms continue to apply going forward.
2. The Service Is in Beta
By opting into the beta, you acknowledge:
- the Service is a work in progress. Features may be added, changed, redesigned, downgraded, removed, or temporarily disabled at any time without notice;
- the Service may break (errors, downtime, crashes, data display anomalies, performance degradation);
- data may be reset. Watchlists, history, preferences, and any other user data may be reset, partially reset, or migrated during the beta window. We will avoid this where reasonable; we cannot promise it will not happen;
- pricing may change, beta-only price points may be retired, and tier feature lists may evolve;
- functionality observed during beta is not a guarantee of post-launch functionality.
3. No SLA, No Uptime Guarantee
The Service is provided without any service-level agreement (SLA) during the beta window. We do not guarantee any specific uptime, response time, error rate, or recovery time. Best-effort operations apply.
4. Best-Effort Support
Support during the beta window is best-effort. We aim to respond to bug reports and questions promptly, but we do not commit to specific response times. Critical security reports (security@[domain]) are prioritized.
5. Feedback
Plain English: If you tell us what to fix, what to add, what's broken, or what's brilliant — we get to use that feedback to improve the Service. We don't have to pay you, credit you, or keep it secret.
We rely on beta participants for feedback. Any suggestion, idea, bug report, feature request, design critique, or other feedback you provide ("Feedback") is governed by Terms of Service §11.3:
You grant us a perpetual, irrevocable, worldwide, royalty-free, sublicensable, fully-paid license to use, copy, modify, distribute, and create derivative works from that Feedback for any purpose, with no obligation of compensation, attribution, or confidentiality.
You retain ownership of your Feedback. We do not claim it as our own; we just receive a broad license to act on it.
6. Confidentiality
During the beta window, you may have access to or learn about:
- features that have not been publicly announced;
- planned changes to existing features;
- internal terminology, branding, or messaging being tested;
- pricing experiments or promotional pricing not generally available;
- screenshots, mockups, or prototype material shared by us.
You agree to keep this information confidential until we publicly announce it or until 12 months after this Agreement ceases to apply to you, whichever is earlier. You may not screenshot or share unannounced beta-only features publicly without our written consent. (Sharing in trusted private channels — small group chats, your personal notes — is fine; public posting on social media, blogs, video platforms, large public Discord servers, etc. is not.)
This confidentiality obligation does not apply to information that:
- becomes publicly known through no fault of yours;
- you knew before joining the beta from a non-confidential source;
- you are compelled to disclose by law (with prior notice to us where lawful).
7. Beta-Period Refunds
During the beta window, the standard refund policy in the Subscription Terms applies, except:
- if we materially change a feature you specifically subscribed for, you may request a refund of the most recent paid period within 14 days of the change taking effect, regardless of the standard "first-subscription-only" rule;
- if we determine the change so substantially altered the Service that it is reasonable to refund all beta participants, we may issue refunds at our discretion without requiring a request.
8. End of Beta
The beta window ends at the earlier of:
- 2026-06-15;
- our public announcement of the end of beta;
- closure of your account.
When the beta window ends:
- this Agreement ceases to apply to new signups (the standard Terms of Service alone apply at signup);
- your existing acceptance of this Agreement remains as compliance evidence (we keep the acceptance row);
- the confidentiality obligation in §6 continues for the period stated;
- the Feedback license in §5 continues perpetually;
- all other obligations transition to the standard Terms of Service.
9. Beta-Specific Disclaimers Stack on Standard Disclaimers
The disclaimers in the Terms of Service (§13) and Risk Disclosure remain in full force during the beta window. The beta-specific acknowledgments in this Agreement are in addition to those — not in lieu of. In particular:
- the no-profit-guarantee disclaimer applies during beta;
- the AI features are tools, not advisors disclaimer applies during beta;
- the Practice Mode is educational, not predictive disclaimer applies during beta;
- the markets are chaotic acknowledgment applies during beta.
If anything, these apply more strongly during beta — beta features are more likely to behave unexpectedly than post-launch features.
10. Termination of Beta Access
We may terminate your beta access at any time, for any reason, with or without notice. Termination of beta access reverts you to the standard Terms of Service relationship; if your underlying account otherwise remains in good standing, the account remains active.
11. Changes
We may update this Agreement during the beta window. Material changes will be communicated by in-app notice and email. Continued use of the beta constitutes acceptance of the updated Agreement.
